Employment Tribunals – outcome

On the second day of the substantive hearing on Wednesday, 10 July, counsel representing the government advised they were not in a position to answer matters relating to the imposition of a structure of fees payable by claimants in the Employment Tribunal. The case will be heard later in the year.  
Although Lord Bannatyne ruled out interim orders when pronouncing his judgment on Thursday, 11 July, the government gave a UK wide undertaking. If the Fees Order is brought into force on 29th July, and the Order is subsequently found to be unlawful, all fees will be repaid in full with interest. The Judge stated that he expected this undertaking to be widely publicised by the government. 
The court has recognised that this action has raised fundamental principles regarding access to justice
