Gordon Deane acted for the successful claimants in the widely reported decision in Dominion Corporate Trustees vs. Debenhams Properties.
This was a significant dispute arising out of the unlawful termination of an agreement for lease of a shopping centre. It involved complex issues of contractual interpretation and repudiatory breach. The claimants were successful on the issue of liability at the first instance.
Debenhams were given permission to appeal. Prior to the hearing of that appeal the parties agreed to mediate. After an extended mediation in London, a settlement was reached. Debenhams agreed to take a lease of a larger unit in the shopping centre.
