Alan Gilfillan

Commercial Law

About Alan

I studied law at the University of Edinburgh and qualified as a Solicitor in 2010.

I have a background in corporate and commercial work, and I have also developed a specialism in  the law affecting Scottish charities.  This was reinforced by a spell on secondment to the Office of the Scottish Charity Regulator.

I joined Balfour+Manson as an Associate in 2014 and was assumed as a Partner in 2017.

I also hold a qualification in investment management.

Alan was able to allay our anxieties and guide us through.

Specialist area

I advise individuals and businesses on commercial matters, including:

  • business sales and acquisitions
  • shareholders’ agreements and partnership agreements
  • commercial contracts, including customer terms and conditions
  • protection and enforcement of intellectual property rights
  • company formation and share transactions

I also work with charities of all shapes and sizes.  I am regularly instructed to prepare charity reorganisation schemes, which can allow existing charities to modernise their constitutions, and even change legal form.  I have established a number of new charities, including a community sports hub and a museum.  As a result of my secondment to OSCR I have a good understanding of the regulator’s approach.  I feel well placed to assist charities (and those who seek charitable status) in Scotland.  I also have experience in assisting trustees who are subject to regulatory inquiries.

More recently I have developed an interest in data protection.  I have provided training for clients in relation to the EU General Data Protection Regulation (GDPR) and the Data Protection Act 2018.  If you are interested in receiving training or have a general query regarding data protection requirements, please just get in touch.
