Professional discipline and regulation cases

Below are some of a range of cases we have acted in the regulatory and disciplinary sphere

  • Firm A and Another v The Law Society of Scotland [2013] CSIH 30

Appeal to the Court of Session against a decision of the Scottish Solicitors’ Discipline Tribunal making a finding of inadequate professional services and against the sanction imposed.

  •  Murnin v The Scottish Legal Complaints Commission and The Law Society of Scotland [2012] CSIH 34      

Appeal to the Court of Session against a decision of the Scottish Legal Complaints Commission accepting a complaint for investigation under the relevant statutory scheme. 

  • Sandeman v The Law Society of Scotland 2011 SLT 505

Appeal to the Court of Session against a decision of the Scottish Solicitors’ Discipline Tribunal in relation to a finding of professional misconduct and a censure order. 

  • Petition of the General Osteopathic Council v Sobande 2011 SLT 377

Petition to the Court of Session for interdict to prevent an individual holding out as an osteopath when not registered.

  • The Law Society of Scotland v The Scottish Legal Complaints Commission 2011 SLT 31

First appeal to the Court of Session under the Legal Profession and Legal Aid (Scotland) Act 2007 against a decision of the Scottish Legal Complaints Commission accepting a complaint for investigation and remitting it to The Law Society of Scotland. 

  • Sheldon v Nursing and Midwifery Council 2010 SLT 1195

Appeal to the Court of Session against a decision of the professional conduct committee of the Nursing and Midwifery Council in relation to whether a suspension of sanction was excessive and whether reasons given were adequate. 

  • Gray v Nursing and Midwifery Council 2010 SC 75

Appeal to the Court of Session against a decision of the professional conduct committee of the Nursing and Midwifery Council contesting findings of guilt and misconduct and the sanction imposed.

  • Y v The Law Society of Scotland 2009 SC 430

Appeal to the Court of Session against a decision of the Scottish Solicitors’ Discipline Tribunal in relation to a finding of professional misconduct and a censure order and fine.

  • Cobb v General Chiropractic Council 2008 SC 73

Appeal to the Court of Session against a decision of the professional conduct committee of the General Chiropractic Council in relation to a sanction of suspension from practice. 

  • Graham v Nursing and Midwifery Council 2008 SC 659

Appeal to the Court of Session against a decision of the professional conduct committee of the Nursing and Midwifery Council challenging the sanction imposed

  • Robson v The Law Society of Scotland 2008 SC 218

Appeal to the Court of Session against a decision of the Scottish Solicitors’ Discipline Tribunal. Appeal involved human rights aspects and whether the Tribunal was an independent and impartial tribunal in terms of Article 6(1) of the European Convention on Human Rights.

  • Tehrani v United Kingdom Central Council for Nursing, Midwifery and Health Visiting 2001 SC 581

Petition to the Court of Session for judicial review concerning whether the professional conduct committee of the UKCC met all of the requirements of an independent and impartial tribunal in terms of Article 6(1) of the European Convention on Human Rights.
