One of the most recent involved the topical area of wind farm planning grants. It was a challenge in relation to the grant of planning permission at the edge of the Cairngorms National Park.
The challenge covered a number of areas in relation to the primacy of the development plan in the decision making process; the Reporter’s approach to determining the issues; failure to take into account supplementary planning guidance and the absence of an appropriate assessment in relation to conservation issues.
