‘Family Law Arbitration Group Scotland’ Launch

The launch of the Family Law Arbitration Group Scotland (FLAGS) took place at the Faculty of Advocates Mackenzie Building on Wednesday 29th February. The previous launch scheduled for Thursday 8th December had required to be cancelled due to adverse weather conditions. 
The well attended launch was addressed by the Chair of the Group, Morag Wise Q.C. and Lord Woolman. The launch was attended by Rosanna Cunningham MSP amongst others. 
The launch marks another step by family lawyers to look for alternative ways of resolving family disputes. 
Arbitration allows families to seek resolution of disputes without a court context. The key issues that a person can seek Arbitration for are where there is an issue of principle between clients which demand a determination and which might accordingly not seem particularly suitable for collaboration or mediation.  Examples include:

How much ailment should be payable?
What are the matrimonial assets worth
Resolution of specific issues re the care of children, including schooling and medical treatment

The advantages of Arbitration for families are:

The ability to choose a decision maker with relevant experience
A quicker process, more flexible and can be tailored toward a focused resolution of the particular issues raised. This may result in the saving of legal costs
