Family Law in a Global Pandemic – Your FAQs…

Can I engage a solicitor just now?

Yes, you can!

We recognise that taking the step of meeting with a solicitor for the first time can be daunting, perhaps even more so during the current times. You may be asking if solicitors are even operating their businesses at the moment as a result of COVID-19 crisis. We are! Although some of our staff are working from the office, most of us are working from home, and we are all working more flexibly which allows us to meet your needs. We have found video calls to be lifelines to our clients. We appreciate that arranging a video call with a solicitor may be even more unnerving than doing it face to face, but we have adapted well to this and we will make sure we put you at ease.  In some ways it is easier and there are new rules for signing documents and checking your identification so we don’t need to meet with you face to face. There are no barriers to us dealing with your case, whether it is in court or not. Our offices are open if you need to drop documents off, or pick something up. So please don’t hesitate to get in touch with us, we’re still here to help you, just in a slightly different way.

What if I need to start a court action – can I do that just now?

The family law courts have adapted to working in new ways to make sure that all family issues can continue to be resolved. Hearings take place by telephone, video conference and very rarely in person. If anything, the raising of applications is often quicker and simpler than it was before lockdown, with paper being kept to an absolute minimum and the majority of actions and applications being raised by email. The team has over recent months become experienced in working with these new procedures to represent clients in courts throughout Scotland. Life is certainly not on hold when it comes to making progress in cases that require court involvement and we are happy to discuss any matter that may require court involvement with you.
